The first council meeting of February
Held Monday evening, February 11, 2008, at 7:30PM, at the Borough Building.

The meeting was opened by the Pledge of Allegiance to the Flag, led by the President-Donald Rabenstein.
Secretary called the roll showing: Council-member Michael Jackson –Council-member Herman Beyer- Council-member Cynthia Blontz – President Donald Rabenstein –Mayor Kenneth L. Davis, II, as all present. Council-member David Shaw was absent when the roll was called.
Others in attendance were: newly appointed Council-member Lloyd Forshey –Secty. Barbara G. Haines – Solicitor Michael Emerick – Engineer Theodore Koch – Chief of Police James Ott – Visitors: Tony Luther – Richard Beard.
Mayor Kenneth L. Davis, II, administered the Oath of Office to Lloyd Forshey, to be a Council-member for the ensuing two years.
Council-member Michael Jackson made a motion, to correct page 2 of the January 7, 2008 minutes, it should have read David Shaw was appointed Chairman Pro –Tem, not Michael Jackson. Council-member Joshua Jackson seconded the motion, all in favor, motion carried.
Council-member Cynthia Blontz made a motion to approve the minutes of the January 30, 2008 minutes. Council-member Lloyd Forshey seconded the motion, all in favor, motion carried.
Council-member Cynthia Blontz made a motion to accept the Duncansville Municipal Authorities minutes of January 3, 2008. Council-member Joshua Jackson seconded the motion, all in favor, motion carried.
Richard Beard was present to ask Council for his $500.00, he says he is entitled to, from the Zoning Hearing that was held on the shed that he wanted to put on the ground that was being condemned. Which was why the Zoning Hearing Board denied the request. He says since we lost the condemnation that we should give him his $500.00 back and his lawyer fees. Our lawyer doesn’t exactly agree with him. Council said he was to bring in the exact figures by the end of the months meeting.
Council-member Joshua Jackson made a motion to accept, the Chief of Police’s report for the month. Council-member Michael Jackson seconded the motion, all in favor, motion carried.
Mayor stated that he would like an up to date list of all employees, and their phone numbers because on Saturday he went to call Glenn out and got Herman. President said for the Secretary to give all council-members a list, the Solicitor said he wanted one too.
Discussion was held on the newly written Police Manual & the Chief stated that there had been some changes, the Mayor said he would review it.
Chief Ott explained to council, that the Police Department wanted to be part of the Western District of Pennsylvania – Johnstown Fugitive Task Force, they will become an ad hoc fugitive task force defined as a multi-agency apprehension effort on specific fugitive case (s) which terminates with the apprehension of the fugitive(s). The primary mission of the tasks force is to seek out and arrest, in a joint, coordinated manner, persons who have un-executed state and federal warrants lodged against them.
Chief said “Our Town “ will cover expenses.
Council-member Michael Jackson made a motion, to have the Secty check with the Police Professional Insurance Company and see if they were going to be covered if anything happened while on this assignment. Confirmation by signature is needed.
Council-member Cynthia Blontz seconded the motion, all in favor, motion carried.
Discussion was held on having a Taster demonstration. Council-member David Shaw said there has been a lot of negative publicity. Mayor said that Everett Chief of Police has one and it works out well for them.
Discussion was held on the amount of bond that Staplefields will need for this project. Solicitor stated he has been working on the Developers Bond with Tom Levine our project Engineer.
Council wants it made known that they do not want Cherry Alley used to haul dirt or for construction vehicles.
Solicitor stated that the Handicap sign at Hazel Piper has to be repealed, because it was put in by Ordinance. If they are not put in by Ordinance, they can’t be enforced by the Police. So the Solicitor stated that when the next Handicap sign is erected, we will officially remove the one on the 1200 Block of 5th. Avenue.
Discussion was held on Gregg Werstil of 1504 not paying his storage shed rent for the month. Secty. to send him a certified letter, referencing the same.
Ted Koch said he had applied for this years CDBG Money and we should get $67,900.00 money this year. It will be combined with last years $52,000.00, to do the stormwater management. Project. It is to be done in accord with the money, for the stream-bank restoration.
Ted says he is working on the calculations for the annual rate calculations with Allegheny & Blair Townships on the amount they owe for their sewer bill. According to the figures he has so far. Right now he needs a figure from the bookkeeper to finish figuring out what the final & true rate calculations will be.
Council-member Floyd Forshey made a motion to accept the Water & Sewer Operators report for the month. Council-member Michael Jackson seconded the motion, all in favor, motion carried.
Council-member David Shaw made a motion to adopt Resolution # 2-08-2,
Tax Anticipation Loan in the amount of $30,000.00. Council-member Michael Jackson seconded the motion and with all in favor, Resolution #2-08-2 was adopted.
President Rabenstein told Joshua Jackson and Lloyd Forshey, that they would have to become NIMS certified, either on line or call Gary Dennis at the EMS Office, to see if there are any classes coming up.
Joshua Jackson is to be head of the Parks Committee &Lloyd Forshey the head of the Fire Company.
Lynn Moyer of 1219 2nd. Ave., complained about what awful shape 2nd. Avenue is in, we had done dirt & gravel work on that avenue two years ago. Council said Glenn should look at it and see if there are any holes he can repair, after the whether breaks.
Council-member Cynthia Blontz made a motion to pay the bills for the month and to accept the financial report subject to audit. Council-member Joshua Jackson seconded the motion, all in favor, motion carried.
President Rabenstein adjourned the meeting.
