1st. Meeting in March 2008 Minutes
The first Council meeting of March, was held Monday evening, March
10, 2008, at the Borough Building, at 7:30PM.
The meeting was called to order by
President Donald Rabenstein with the pledge of Allegiance to the
Flag.
Secty. called the roll showing: Council-member Herman Beyer –
Council-member David Shaw –Council-member Lloyd Forshey -Council-
member Cynthia Blontz – President Donald Rabenstein –
as all present. Council-member Michael Jackson & Council-member
Joshua Jackson and Mayor Kenneth L. Davis, II, were all absent when
the roll was called.
Others in attendance were: Secty. Barbara G. Haines- Solicitor Michael
Emerick – Engineer Theodore Koch – Chief of Police James
Ott –Newsreporter Kay Stephens – Visitors Tony Luther
– Richard Beard.
Council-member Lloyd Forshey wanted to make a correction in the
February 11, 2008 minutes, on Page 2, the Secretary had written
Floyd Forshey instead of Lloyd Forshey. Council-member Cynthia Blontz
made a motion to approve the minutes of February 11, 2008, after
the correction was made. Council-member Lloyd Forshey seconded the
motion, all in favor, motion carried.
Council-member Lloyd Forshey made a motion to approve the minutes
of the second Council meeting in February, held on February 27,
2008. Council-member David Shaw seconded the motion, all in favor,
motion carried.
Mayor Kenneth L. Davis, II entered the meeting at 7:45 PM.
Council-member Lloyd Forshey made a motion to accept the minutes
of the regular Duncansville Municipal Authority Meeting, held February
7, 2008. Council-member Cynthia Blontz seconded the motion, all
in favor, motion carried.
Richard Beard was present to get his money that he had been awarded
through the Zoning Variance being overturned in his favor. The President
gave him the $1,300, he was to get back because where he wanted
to erect a shed on the ground that was part of the eminent domain
suit. He also wanted to know where his $15,742.89 plus interest
was. He was told he should have his $15,742.89 by Thursday afternoon,
and the Solicitor and Richard Beard didn’t see eye to eye
as far as the penalty goes. He claims that we are in defiance of
the Judges court order, that the interest was to start at the end
of the 30 days. Our Solicitor doesn’t exactly agree with him.
Council-member Joshua Jackson & Council-member Michael Jackson
entered the meeting at 8:20PM..
Discussion was held on Methadone Clinics and whether the Borough
was going to try and do anything to keep them out. Tony Luther who
had attended the meeting that Allegheny Township had, had concerning
the clinics and he had drawn up a Moratorium Ordinance, for council
& the Solicitor to review. The overall laws are loosening as
far as the State & Superior Judges are concerned. Solicitor
to write up a proposal and study the existing moratorium, and see
if he can come up with anything that is legal.
Council-member Cynthia Blontz made a motion to accept the Police
Chiefs report for the month. Council-member David Shaw seconded
the motion, all in favor, motion carried.
Council-member Cynthia Blontz made a motion to purchase four tires
for the D-1 Police car (white one) @ $113.14 each under State Contract.
Council-member Joshua Jackson seconded the motion, all in favor,
motion carried.
Chief Ott explained to Council that they are giving out Orange Tickets
as warning tickets for any violations, parking, trash, abandoned
vehicles etc., he feels it is working well. This is replacing the
letters
Of violation that previously were sent out.
Discussion was held on the Nuisance Ordinances & our disorderly
conduct Ordinance . According to Jim Ott, the two Ordinances are
similar. The nuisance ordinance, has a lot to do with problem houses.
Council-member Michael Jackson made a motion to have the Solicitor
review Nuisance Ordinance.
Council-member Cynthia Blontz seconded the motion, all in favor,
motion carried.
Council-member Michael Jackson made a motion to adopt Resolution
# 3-08-1 $30,000.00 Tax Anticipation Loan. A copy of which is on
file due to the length of the Resolution, it will not appear in
the minutes. Council-member Cynthia Blontz seconded the motion,
all in favor, motion carried.

Discussion was held on Developers agreement for the 32-Unit Townhouse
Development. The Solicitor said – Parkway Developments Lawyer
is going over the agreement. Attorney Emerick has made sure that
there is a clause in their for a bond for $5,735.00 for use of our
Borough streets by Heavy Trucks, surrounding the project, so as
not to damage our streets from the weight etc.
There is a $500.00 violation clause if any truck or heavy equipment
uses Cherry Alley as an access, to the development.
Discussion was held on Mr. Werstil and the problems he has been
causing over not getting permits not paying for storage rent, you
name it. Then he tried to put his shed (Trailer 48’) on the
Tax Rolls, by calling the Assessment Office and trying to get it
put it on by himself, that didn’t work. Our Engineer has since
told the Zoning Officer – (Secty.) that he can’t make
it a permanent structure due to the fact that it is on wheels and
is in the flood plain.
Council-member Joshua Jackson made a motion to have the Solicitor
write him a letter this time and try to make him understand what
he can and cannot do within the Law. Council-member Michael Jackson
seconded the motion, all in favor motion carried.
Ted Koch said he was up last week and checked the stream & 14th.
Street etc, & it wasn’t really to bad. He also said he
would review Stu Sibolds plans for the upgrade to our sewage treatment
plant, for compliance with our Land Development rules & regulations.
Council-member Cynthia Blontz made a motion to wave fee for the
application, since it is the Sewer Authority. Council-member Lloyd
Forshey seconded the motion, all in favor, motion carried.
Council-member Cynthia Blontz made a motion to accept the water
& sewer operators report for the month. Council-member Lloyd
Forshey seconded the motion, all in favor, motion carried.
Council-member Joshua Jackson said he would continue to check on
Grants for the Park, because there are a lot of needs for the park
to keep it in good repair.
He has contacted Denny from Game Time about getting 100 cubic yards
of Engineered Wood Fiber for the playground, he said he is waiting
for him to fax a paper to the Borough Office, so he can order it.
It will cost $2,400.00.
Discussion was held on the repairs that are desperately needed to
the Racquetball wall & the Tennis Court.
Council said that Charles Gomerjac should check with the HSBL about
getting a key to their shed, to keep Roaring Spring School Districts
bases, liner & lime in for the baseball field.
Council-member Cynthia Blontz made a motion, to pay the bills for
the month and to accept the financial report subject to future audit.
Council-member Herman Beyer seconded the motion, all in favor, motion
carried.
President Donald Rabenstein adjourned the meeting.
